David is counsel at Orrick Herrington & Sutcliffe LLP, where he focuses on complex privacy and cybersecurity litigation. He has extensive experience working with corporate clients that have suffered data breaches or have been accused of privacy violations, defending them against class actions and claims asserted by payment card brands and representing them in connection with federal and state government actions. David was a member of the team that, on behalf of cancer detection laboratory LabMD, successfully petitioned the U.S. Court of Appeals for the Eleventh Circuit to overturn the first-ever FTC decision holding a company liable for allegedly “unfair” cybersecurity practices under Section 5 of the FTC Act. David also publishes extensively on the latest legal issues in the cybersecurity space and serves as a resource to reporters and others writing on breaking legal developments.
